Newburgh Four Trial Update

The trial for the Newburgh 4 trial began this past week. The FBI confidential informant is expected to testify on Monday, and possibly Tuesday.

According to those who attended the first few days, the trial is quite interesting and the Judge is very fair.

The trial is at 500 Pearl Street, NYC, Courtroom 14C, Mondays through Thursdays, and is expected to last for six weeks. Please consider attending if you can.

Here are some brief notes on what Alicia told me happened today.

Malik (I will use his Albany name) came over to this country on a fake visa. The defense brought up the DMV stuff that Malik was involved with. Malik was in jail in Pakistan.

FBI Agent Rober Fuller was on the stand. The defense asked about payment for Malik. Fuller said that Malik was paid $77,000 and $96,000. The defense asked if Fuller had receipts. Fuller did not seem to be able to answer the question. The Judge told Fuller that was a yes or no question. The defense wants the government to produce the receipts and the government is objecting.

I think I have this correct: Fuller sent Malik to Pakistan spring of 2010 (no reason given). BUT, Malik could not get back in the country because he is on a “no fly list”. So, Fuller had to go to the airport to get Malik.

It turns out that Malik did not tape the first two or three months of his meetings with James Cromitie (the “ringleader”).

Malik owns a hotel (Alicia is not sure where, but, when I mentioned Loundonville, she thought that sounded familiar. The address of the hotel that Malik owns will be in the transcripts).

Fuller was on the bomb squad. He is the one who suggested that bombs be used in the plot.

A memo on May 13, 2009, explained exactly what Malik was to do on May 16, 2009. The entire plot was scripted by the FBI.

Alicia said it was clear today that the four men had no money and no driver’s licenses. Onta Williams’ lawyer asked how the men were going to pull off the plot – on bicycles?!
